BACKGROUND

  • Midwest private equity sponsor recently acquired platform company

  • Legal due diligence highlighted red-flag issues relating to the new company’s I-9 forms

  • Company does not have a formal HR function and I-9 responsibilities are fragmented across Finance and Operations

  • Sponsor seeking an independent, third-party to conduct I-9 audit and make recommendations for corrections

SCOPE

  • Establish working relationship with portfolio company CFO

  • Establish audit plan including full review of active I-9 forms and documentation of issues/recommended corrections

  • Recommend compliant I-9 process for future hiring and file maintenance

Deliverables

  • Collected and audited all I-9 forms for active employees in accordance with USCIS employer guidelines

  • Identified and documented more than 200 inaccurate or incomplete forms

  • Identified associated correction for each error under USCIS guidance

  • Provided counsel to CFO on potential penalties for non-compliance

  • Provided roadmap to undertake correction process and associated employee communication

  • Delivered recommendation for compliant I-9 process

  • Transitioned follow-up to internal team
