Legal due diligence highlighted red-flag issues relating to the new company’s I-9 forms
Company does not have a formal HR function and I-9 responsibilities are fragmented across Finance and Operations
Sponsor seeking an independent, third-party to conduct I-9 audit and make recommendations for corrections
SCOPE
Establish working relationship with portfolio company CFO
Establish audit plan including full review of active I-9 forms and documentation of issues/recommended corrections
Recommend compliant I-9 process for future hiring and file maintenance
Deliverables
Collected and audited all I-9 forms for active employees in accordance with USCIS employer guidelines
Identified and documented more than 200 inaccurate or incomplete forms
Identified associated correction for each error under USCIS guidance
Provided counsel to CFO on potential penalties for non-compliance
Provided roadmap to undertake correction process and associated employee communication
